Fitness For Real Pty Ltd provides recreational services and recreational activities within the meaning of section 5K of the Civil Liability Act 2002.

 

 

 Risk Warning

 

 

Participation in gym activities, including but not limited to:

 

  • Strength training

  • Use of free weights and machines

  • Cardiovascular exercise

  • Group training sessions

  • 24-hour facility access

  • Use of fitness equipment

 

 

Involves inherent and obvious risks of injury, including but not limited to:

 

  • Muscle strain

  • Sprains

  • Fractures

  • Equipment malfunction

  • Serious injury or death

 

 

By attending our premises or participating in recreational activities, you acknowledge that you voluntarily assume all obvious and inherent risks associated with such activities.

 

 

 

4. Limitation of Liability (Recreational Services)

 

 

To the extent permitted under section 139A of the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law), Fitness For Real Pty Ltd excludes liability for death or personal injury arising from the supply of recreational services.

 

Where liability cannot be excluded under the Australian Consumer Law, our liability is limited to:

 

  • The re-supply of the services; or

  • The cost of having the services supplied again.

 

 

Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law that cannot lawfully be excluded.

 

 

 

5. Memberships & Third-Party Sign-Up Platforms

 

 

Membership agreements are entered into via a third-party membership management or direct debit platform.

 

By purchasing a membership, you agree to:

 

  • The Membership Agreement

  • Direct Debit Terms (if applicable)

  • Facility Rules

  • Any waiver or declaration required at sign-up

 

 

In the event of inconsistency, the Membership Agreement prevails over these Website Terms.
